Robert Santos reporting
County judge investigated for sexual misconduct

Updated:

An investigation into sexual misconduct involving a minor is underway.  The person accused is a Clark County family court judge.

A formal complaint was filed on Friday against Judge Nicholas Del Vecchio. As of Monday, he remains on the bench but his future in handing down the law is in question.

As News 3 Robert Santos reports, there's more than one person accusing the judge of inappropriate behavior.

Since being elected to the district court bench in 2000, Nicholas Del Vecchio has presided over local adoption and domestic violence cases. Now the spotlight is on him. A complaint filed by the Nevada Commission on Judicial Discipline lists 38 different allegations against Del Vecchio.

Most notably, one involves a 29-year-old woman who worked for him in family court. The alleged victim, who's the daughter of his former wife, accuses Del Vecchio of forcing her to have sexual relations with her in order to keep her job.

Her allegations date back to the early 90s when she claims Del Vecchio made her perform fellatio on him when she was 14-years-old. Her mother, who was Del Vecchio's girlfriend at the time, worked for him in his own law firm.

The alleged victim also claims Del Vecchio took her shopping for clothes on the condition she model them for him and says he promised to continue assisting her if she'd perform nude.

About a decade later, after he became a judge, the alleged victim told the commission the sexual relations continued, that she "needed to become drunk in order to do so" and that Del Vecchio "provided the alcohol."

When she refused to participate, she says he treated her in a retaliatory manner and created a negative working environment.

The 31 page report lists numerous other complaints from several court and non-court workers. People claiming he's made not only sexual comments, but inappropriate remarks against Mexicans, Jews, Asians and blacks.

The commission's executive director says Del Vecchio has denied the allegations, but the judge has 20 days from the day he's served to formally respond. Then a hearing will be set.

Keep in mind, these aren't criminal charges being brought against Del Vecchio. This is an ethics investigation. When and if he's found guilty, Del Vecchio could face anywhere from public reprimand to total removal from office.

Chief Judge Kathy Hardcastle says she's looking into the matter. If she finds Del Vecchio's presence is affecting the case load at family court, she'll consider taking him off the bench until the hearing.
