Wynn Resorts files suit over 'XS' trademark

A lawsuit has been filed over a trademark that's the name of a luxury nightclub at Steve Wynn's Encore casino resort in Las Vegas.

Wynn Resorts Holdings filed a lawsuit Monday in U.S. District Court against Atlanta-based NYLO Hotels, an operator of boutique hotels.

NYLO asserted rights to the trademark "XS" and offered to let Wynn pay a licensing fee to use the name for the club at Encore.

In the lawsuit Wynn Resorts claims it has spent time, resources and money to develop and promote a restaurant, bar and nightclub at Encore under the XS mark.

The suit says Wynn's use of the XS mark doesn't infringe on NYLO's rights.
